1. Acceptance of Terms
By accessing our website or contracting EBS Home Care LLC for residential or commercial masonry, chimney sweeping, or fireplace installation services, you agree to be bound by these Terms of Service.
2. Service Estimates and Contracting
All quotes provided by EBS Home Care LLC are upfront and flat-rate based on forensic diagnostics and visual inspections. We operate in strict alignment with the Missouri Merchandising Practices Act, ensuring a transparent marketplace free of bait-and-switch pricing, deception, or false promises.
All residential repair, remodeling, and construction contracts are governed by the Missouri Home Improvement Fraud Act (Chapter 407, RSMo). We guarantee that all structural modifications, including stainless steel relining, gas insert installations, and concrete crown pours, comply with local St. Louis County building and mechanical codes.
3. Right to Cancel (Insurance Claims)
We frequently assist homeowners with repairs related to storm damage, lightning strikes, and chimney fires. If you have entered into a written contract with EBS Home Care LLC for services to be paid under a property and casualty insurance policy, Missouri law grants you specific cancellation rights. You may cancel the contract prior to midnight on the fifth business day after receiving written notice from your insurer that all or any part of the claim is not a covered loss. Cancellation must be provided to us in writing at our Overland headquarters.
4. Liability and Warranties
Insurance: EBS Home Care LLC carries over $2,000,000 in specialized commercial and residential liability insurance. We maintain full workers’ compensation coverage for all of our direct employees.
Warranties: We provide written warranties on specific installations, such as lifetime transferrable warranties on our heavy-wall stainless steel liners and top-sealing dampers. Warranties do not cover damage resulting from future natural disasters, neglect, or the burning of improper fuels.
5. Code Compliance and Permits
EBS Home Care LLC acts as the responsible party for securing necessary municipal permits for structural masonry and gas routing in St. Louis County. Homeowners and property managers agree to provide our technicians with safe, unhindered access to the property to execute the contracted work and facilitate municipal inspections.
6. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the State of Missouri. Any disputes relating to these terms shall be subject to the exclusive jurisdiction of the courts of St. Louis County.
